What Are Our Rights/Recourse in Law?
Bought set of solar lights at Lowes. One of the lights combusted during the afternoon having been in ground 5 days, and assembled/inserted correctly. Damage caused to side of house siding and some plants. Possible damage behind the siding. Fire Dept. called and report compiled. Have called Lowes who say it’s the manufacturers responsibility to resolve the matter. Have left message with manufacturers "claims dept." and am awaiting a response. Any info/comments/suggestions on this from anyone who knows about such things? Thanks!
At this point, continue to negotiate with whomever appears most willing to reimburse you.
But, if it gets to the point where neither is cooperative, and your damages are extensive, and you need to sue, you can legally sue either Lowe’s or the manufacturer. All entities involved in the manufacture, distribution, and sale of a defective product are liable for the damages the product causes.
